ILLEGAL STRUCTURES ON GOVERNMENT LAND
Sometime in April 2009, numerous BU residents, whose homes had illegal structures on government land (buffer zone behind the houses), were instructed by MBPJ & the Petaling Land Office to dismantle them. While BURA recognizes those are illegal extensions and cannot rightly support its existence, we have made representations with MBPJ to give residents time to resolve their predicaments through the right channels.
Some residents used the idea of a TOL, and have submitted applications to the authorities.
It did seem that some folks hoped that once a TOL application was in place, no further enforcement action would be taken. This, coupled with bad advice from some interested quarters, caused more residents to begin constructing their illegal extensions. There was much disinformation, and BURA pressed for a conclusive guidance from the ADUN and/or MBPJ.
Meanwhile, other BU residents have also offered the reason of soil erosion as the justification to build these extensions. In April 2009, MBPJ was going to commence demolition activities against Bandar Utama house owners. However, the State Government granted a stay pending the submission of a soil erosion engineering report, but it has yet to sight it. If the report is challenged to be without-basis, then the penalty will be harsh.
State Government Decision on the TOL and Soil Erosion
1. The TOL applications have already been rejected, mainly because you cannot build permanent structures on such land.
2. If there indeed is soil erosion in the buffer zones, the State Government is duty-bound to make repairs to correct the matter. But the repairs cannot be made if there are permanent structures already there.
The Facts As It Is
1. There are plans already drawn to widen Lebuh Bandar Utama perimeter roads at BU11/BU12 in tandem with other traffic management initiatives, where buffer space may be reclaimed. This is expected to happen sometime in 2012, when all the other initiatives come together.
2. BUCC has lodged a covering complaint to MBPJ of houses with illegal extensions along those roads that it has yet to hand over to the state.
How Will This Affect You?
1. If you do not have, and do not plan to build extensions that cross over onto state-owned buffer land, it will most likely be a non-issue.
2. If you are planning to have such extensions built, please DO NOT PROCEED, regardless of what your friends with similar structures tell you. Especially do not listen to your contractor's ill-informed or ill-intentioned advice.
3. If you have already started building, please be advised to change your plans now.
4. If you already have such structures in place, unfortunately, you will likely face the prospect of fines, and a directive to have those taken down. Taking them down forcibly may damage neighbouring legally-compliant structures.
A prominent politician also mentioned that, as relatively well-to-do folks, we tend not to appreciate the hardships of people who squat on state land, but in this case, some of us are guilty of the same.

RA wants Bandar Utama residents to stop constructing illegal extensions |

Several houseowners in Bandar Utama have encroached onto the road reserve (buffer area) behind their properties by building extensions, much to the concern of Bandar Utama Residents’ Association (Bura).
Most of the extensions measure from 18 sq m to 28 sq m.
Bura fears that lack of action by the Petaling Jaya City Council (MBPJ) and Selangor government may prompt more houseowners in Bandar Utama to construct such illegal extensions.

“If you look at some of the houses, the backyard extensions have nearly reached the pedestrian pavement,” said Bura chairman Lim See Meng.
Bura wants the problem to be stopped before more houseowners start building illegal extensions.
They said the illegal encroachment on state land might also hamper the proposed plan to widen Lebuh Bandar Utama perimeter roads.
“Bandar Utama is in between the Damansara-Puchong Highway (LDP) and the North Klang Valley Expressway (NKVE). There is still construction work going on there, including a condominium project which will bring in more traffic.
“It is just a question of when the authorities are going to widen the road to cater to the increase in traffic volume,” said Lim.
The problem, he said, had been going on for over a decade.
“Now there are over 100 houses in Bandar Utama that have illegal extensions. Some have just finished construction of their new backyards,” said Bura committee member Dr Tock Min Kin.
“A few of the residents have come to us asking for our support in allowing them to carry out extensions, but it is not possible for us to support this,” he added.
“What we could do is to make representations to MBPJ to give the residents time to resolve the problem through correct channels,” said Dr Tock.
Among the reasons used to justify the extensions, Bura said, was soil erosion, while others suggested to apply to the relevant authorities for a Temporary Occupation Licence.
Common practice: Despite circulars by Bura to residents to not undertake backyard extensions, one houseowner has just completed an extension, as evidenced by the waste bin placed on the five-foot way in BU 6.

Residents highlight issues affecting them during meeting
A MEETING between members of the Bandar Utama Residents’ Association (Bura), Bukit Lanjan BN coordinator Francis Chong and Lingkaran Trans Kota (Litrak) on Tuesday saw a number of local issues raised by residents.
However, the attendees were disappointed when representatives from Petaling Jaya City Council (MBPJ) withdrew at the eleventh hour.
One of main issues unanimously raised by residents to Chong was the poorly-resurfaced roads.

Illegal extensions on govt land
BUKIT Lanjan state coordinator Francis Chong Tuck Chiew has urged the Petaling Jaya City Council (MBPJ) to crack the whip on the 97 houseowners in Bandar Utama who have carried out illegal renovations that encroached onto the road reserve.
“Most of these extensions measuring between 18sq m and 28sq m has encroached onto the road reserve and can cause problems in the future when there is a need to widen the road or if a water pipe burst below the extension,” he said.
Chong said MBPJ must not be afraid of political pressure in the state but carry out their duties.
“Legal action should be taken and the extensions build without the council’s building approval must be demolished,” he said.

Protruding: An illegal extension in Bandar Utama.
On April 26, The StarMetro frontpaged the report where Bandar Utama Residents’ Association had raised concerns on the illegal extensions and that the council had kept silent thus prompting other houseowners to follow suit.
Chong, who had earlier coordinated the Implementation Coordination Unit dialogue session under the Prime Ministers’ Department where residents from Bandar Utama had brought up the matter, said there were many issues in various neighbourhoods that the local councillors and the assemblymen were not looking into.
Several officers from the Prime Minister’s Department including the development officer for Petaling Zone Syamsul Nizam Shamsuddin was present.

Dear Good Neighbours,
One behalf of the committee , I would like to wish all the Chinese residents celebrating the festival a " GONG XI FA CAI" as well as a great, successful and prosperous New Year ahead. May the New Year be full of God's Blessings upon you and your family.
We know the generousity of many residents who would like to give "ang pows" to our guards which is commendable. Previous years, some of the guards especially those stationed at the guard house and during the day received much, much more than the rest (difference from RM200 - RM900-something to that effect). In order not to disrupt the patrols during this holiday and having more guards than necessary at the guard house, we suggest that you drop your " ang pows" in an envelope into the drop box which is located at both entrances. It can be address to the committee. The committee would then collect them and give out to the guards more equitably. There are a total of 10 guards ( 6 in the day & 4 at night ).
As for those having a holiday break , do have a great time with your family. Please keep your homes locked and lit if you are going home/ balik kampong. It is also good to inform your neighbours to keep an eye for you and also let the team leaders of the guards know. They have been told to keep watch over the homes of the residents that will be away.I would be in our Kampong BU6.
